Госдума рассматривает законопроект № 42197-6, расширяющий право органов опеки и попечительства на социальное вмешательство во внутрисемейные отношения граждан.

Госдума рассматривает законопроект № 42197-6, расширяющий право органов опеки и попечительства на социальное вмешательство во внутрисемейные отношения граждан.

Законопроектом вводится новая форма индивидуальной профилактической работы с ребенком, проживающим в семье, находящейся в социально опасном положении, и его родителями, осуществляемой органами опеки и попечительства, – социальный патронат.

Согласно документу, социальный патронат устанавливается органом опеки и попечительства в случае, если по результатам обследования условий жизни, воспитания и развития несовершеннолетнего установлено, что родители или иные законные представители несовершеннолетнего, находящегося в социально опасном положении, создают своими действиями условия, препятствующие его нормальному воспитанию и развитию, и отрицательно влияют на его поведение.

Кроме того, социальный патронат может быть установлен судом при рассмотрении дел об ограничении или лишении родительских прав, если нет достаточных оснований для ограничения или лишения родителей  родительских прав.
